Terms and Conditions for a Trusted Experience

This document sets out the conditions governing the use of this website to ensure a transparent and secure experience when using our services.

We recommend that you carefully read the terms of our Cookies Policy and our Privacy Policy in order to make proper use of our website and the services offered.

1 – Introduction

By using or visiting the Site hosted at www.querciahouses.com and/or www.querciahouses.pt or any of the information, data files, written text, graphics, links, audio files or other sounds, photographs, videos or other images (collectively, “Content”), resources and services, (collectively, “Services”) available through it, you consent to and accept the Terms of Use and Booking Conditions, the privacy and data protection policy available at Privacy Policy.
The Website is owned by the company Quercia S.A. (hereinafter and for this purpose referred to as “Quercia Houses”, a public limited company with registered offices at Rua João Martins Viana, Bloco C, n.º 105, 4900-746 Viana do Castelo, registered with the Commercial Registry Office of Viana do Castelo, under the single registration number of legal person 504798367, with a fully paid-up share capital of EUR 500,000.00 (five hundred thousand euros).
Through the Website, Quercia Houses gives the User access to the Services including updates, developments, new tools and/or new web properties that are subject to these Terms of Use.

Quercia Houses reserves the right to amend this Terms of Use document at any time, without prior notice, and it is the User’s sole responsibility to check and comply with them at the time of each use. Access to the Services and Content for purposes other than those for which the Site is intended is expressly prohibited, including, but not limited to, the following

2 – Quercia Houses’ rights and obligations

Quercia Houses reserves the right to:

2.1. modify, add or remove parts of the Terms of Use;

2.2. modify or terminate the Services at any time for any reason and without prior notice;

2.3. modify, replace, refuse access to the Site and the Services, suspend or discontinue them, partially or totally. These changes will take effect from the time they are placed on the Site or from the date any communications are sent.

3 – Liability Limitation

To the extent permitted by applicable law, Quercia Houses assumes no liability to the user for:

3.1. any damages resulting from:

3.1.1. any changes that Quercia Houses may make to the services or even the permanent or temporary cessation of such services (or any functionalities of the Service);

3.1.2. the deletion, corruption or storage error of any content or other communications data maintained or transmitted through the Services;

3.1.3. breach (direct or indirect) of these Terms of Use
In the event that the User does not agree, in whole or in part, with these Terms of Use of the Website or the Services, he/she has at his/her disposal only the possibility to stop using the Website or the Services or to demand the cancellation of his/her user account, as applicable.

4 – Accommodation

4.1. The characteristics of Quercia Houses and its rooms are those mentioned in the booking. However, taking into account that the photographic contents on the Website were not realised at the time of booking by the Client, there may be significant differences between the photograph and the reality at the time of the enjoyment contracted by the Client, which do not entitle the Client to any modification of the Contract.

5 – Prices and Fees

5.1. The prices shown on the website refer to the basic capacity of each type of house. The basic capacity of each house is defined according to the number of existing beds. If you make a reservation for more people than the basic capacity of the Accommodation, you will be charged an additional cost. The price of the stay to be paid by the client is the consideration for the use of the house for the period between arrival and departure. The total price of the stay will be charged per night, regardless of whether the customer has actually used the house or spent the night there.

5.2 The prices shown include Wi-Fi Internet according to the conditions in force at the time. Prices differ according to the age of the customer. For children from 0 to 3 years old, who have a crib, the stay is free, but only subject to availability and prior reservation. For children aged 3 to 12, the cost of the stay will be 50% of the listed price, whether they are accommodated in an extra bed or sofa bed, if the house has one available. Guests aged 13 and over are considered “Adults” and therefore the cost of the stay per person is calculated and applied at 100%.

5.3 The applicable rates are the prices agreed in euros or the price indicated in euros in the Quercia Houses rate list in force on the date of conclusion of the contract. The rates for the year 2023 are indicative and may change. Confirmation of the price for the date of your stay must be made in the reservations section of the website.

6 – Pre-booking and Reservation

6.1 Booking conditions

All payment methods are accepted.

6.2 Rules for making a reservation

You may be required to guarantee your reservation by pre-payment or by credit card. Quercia Houses reserves the right to pre-authorize credit cards. The reservation made by the Client is considered final once Quercia Houses has confirmed it. Upon confirmation of the reservation, 50% of the amount will be charged.

6.3 When filling in the booking form, the Client will be asked for certain data that can identify him/her (“Personal Data”), which will be collected by Quercia Houses and processed by it, in strict compliance with the law and in accordance with the provisions of the Website’s Privacy Policy.

6.4 Procedures in the event of Overbooking

In the event of Overbooking (impossibility of accommodating the Client due to excess of accepted and confirmed reservations in the accommodation) the Guest will be relocated to a unit of the same category or higher and in the same regime;

7 – Type of booking and cancellation

Quercia Houses offers different types of reservations and rates, including the NON-REFUNDABLE rate. All reservations and rates, with the exception of the NON-REFUNDABLE RATE RESERVATION, consist of the reservation of a house, accompanied by the provision by the client of valid and complete details of a credit card or other means of guaranteeing the reservation. When the customer makes the reservation, 50% of the total amount will be charged. By opting for this rate, you benefit from a free cancellation period up to 15 days before arrival. If the reservation is canceled within this period, the client will be refunded the total amount previously paid minus a 3% administrative fee. At the end of the 15-day cancellation period, the amount for the first night will be charged. A reservation with the NON-REFUNDABLE RATE consists of the reservation of a house for a specific date, accompanied by the customer providing valid and complete details of a credit card or other accepted means of payment. The total amount of the reservation will be charged when the customer makes the booking. When opting for this rate, there is no cancellation period, so there will be no refund in the event that the Customer is unable to use the booking previously made on the date stipulated. In the event of early departures, no refunds will be made.

8 – Check-in and Check-out times

Quercia Houses stipulates that the Client’s entry into the previously booked house – “check-in” – takes place from 15:00. Guests must present valid personal identification at check-in. This obligation extends to all occupants of the room, including children.

On the day of departure previously stipulated in the reservation, the Client must leave the house – “check-out”, by 11:00 a.m., leaving it free of people and goods. In the event that the client does not leave the house by 11:00 a.m., Quercia Houses may demand payment of a fee of up to 100% (one hundred percent) corresponding to the reservation of one night based on the table provided in 5.3. Payment of this fee does not entitle the Client to stay in the accommodation.
The times mentioned are local times where Quercia Houses is located.

9 – Terms of use

For the proper use and operation of the space, it is necessary to comply with the following Terms of Use:

9.1 Quercia Houses assumes that only the people indicated in the accommodation reservation will have the right to use the house.

9.2 The presence and movement of pets in the rooms and spaces of the accommodation is strictly forbidden, with the exception of duly accredited guide dogs and those houses that allow pets, namely The Sun House and Cherry House.

9.3 The Client must respect other clients and the rules of good conduct.

9.4 The Client is not allowed to use the reserved access areas.

9.5 Children under 12 years of age must be accompanied by adults at all times during their stay.

9.6 The Client is entirely responsible for the property left at Quercia Houses and has a duty to supervise it during their stay.

10 – Payment terms

The amount of the stay and additional services previously contracted must be paid in advance when the Client arrives at the accommodation, regardless of the billing date.

In the case of stays without a specified departure date, Quercia Houses will demand payment for the accommodation and other services every seven days of the stay. Failure to pay will result in immediate cancellation of the contract.

11 – Benefits, promotions, discounts and special campaigns

It is not possible to choose overlapping promotional programmes/packages. All rates include VAT at the rate in force and are subject to limited availability.
11.1 Quercia Houses may run certain promotions (“Promotions”) and discounts (“Discounts”) on the Website, whether or not they are limited in time.

11.2 The following conditions apply to Benefits, Promotions and Discounts:
i) In order to benefit from certain Promotions and/or Discounts, the Customer may be required to enter a promotional code (“Promotional Code”) or pay for the booking in advance;

ii) Benefits, Promotions and Discounts are subject to confirmation of availability;

iii) Quercia Houses reserves the right to cancel Benefits, Promotions and/or Discounts without prejudice to bookings already made, confirmed and paid for or guaranteed.

iv) The cancellation or non-use of a reservation made under a Benefit, Promotion or Discount does not entitle the Client to a refund of the value of the Benefit, Promotion or Discount, nor does it guarantee its reuse in another reservation;

v) If there is a change, on the Client’s initiative, in the characteristics and/or ownership of a booking made within the scope of a Benefit, Promotion or Discount, Quercia Houses reserves the right to cancel the benefit/discount granted by the booking;

vi) The use of fraudulent mechanisms to obtain Benefits, Promotions or Discounts shall render the Client liable in general terms and shall entitle Quercia Houses to terminate the Contract, without prejudice to Quercia Houses’ right to be compensated for all damages suffered;

12 – Complaints

Any notifications and communications from Quercia Houses to the User under the Terms of Use and Booking Conditions should preferably be made to the email address or address provided by the User, without prejudice to Quercia Houses being able to use other elements and forms of contact.
Any notifications, communications and complaints from the User should preferably be sent to the email address reclamacoes.quercia.sa@quercia.pt. Complaints may also be made through the Electronic Complaints Book available on the Quercia Houses website.

13 – General provisions

The General Conditions apply only to the booking of services made through the Website, and are a complement to any special conditions agreed in writing between the Client and Quercia Houses regarding the subject matter of the Contract or referred to in a specific area of the Website for a particular product or service, including the booking receipt (“Special Conditions”), which are also an integral part of the Contract.

The provisions of the Particular Conditions shall prevail, in the event of conflict, over the General Conditions, and any additional written stipulations specially agreed between the Client and Quercia Houses and signed by both, which form part of the Contract, shall prevail over both.

Once the Contract has been entered into, it can only be amended in writing, by a document signed by the Client and Quercia Houses, which becomes an integral part of it.
The provisions of these General Conditions may be amended at any time by Quercia Houses for future legal relations, without prior notice. Therefore, whenever you make a booking, and even if you use the Website frequently, you should read them in full.

14 – Force majeure

Quercia Houses shall not be liable for any defect or delay in the fulfilment of its responsibilities, if and to the extent that such defect or delay is caused, directly or indirectly, by fire, flood, earthquake, natural phenomenon, riots, strikes, civil disorder, imposed quarantines, epidemics, pandemics or any other causes beyond the control of Quercia Houses.

15 – Conflict management

De acordo com a Lei nº 144/2015 informamos que em caso de litígio, o foro competente para onde o consumidor poderá recorrer, será:

16 – Applicable law and courts

These Terms and Conditions are governed by Portuguese law and the resolution of any dispute arising from the interpretation and execution of these General Conditions shall be subject to Portuguese law and courts.
